1. Who is BlueNav?

BlueNav, whose registered office is at 17 rue du Capitaine Allègre, 33120 Arcachon (hereinafter “BlueNav”, “we”, “us” or “our”) is the party responsible for processing your personal data.

2. Why do we collect and process your Data?

In compliance with applicable data protection legislation, we use your data, including that which you have provided to our network, to update the information we hold about you as the owner of one of our engines or as a person interested in the BlueNav brand. This also includes the transmission of this data to our network to ensure that your personal data is correct and up to date.

This processing is based on the legitimate interest of BlueNav and our partners in maintaining the quality and accuracy of owners’ and prospects’ personal data.

We use your data to offer you our services and to respond to your requests. This information is collected for the purpose of fulfilling a contractual obligation or pre-contractual measures.

 

We may use your contact details (SMS, e-mail address, telephone, postal address and/or any other available means) to send you promotional messages and customer surveys that include marketing content. These communications concern the BlueNav brand.

 

We use your data, in particular data from your activities, engine-related data, your geolocation data and data collected by browser, device and app, to improve our services (e.g. our website and app, promotional messages) and to show you content that may be of interest to you, also on social networking platforms or programmatic advertising platforms.

 

Where we target you on social network platforms or through programmatic advertising platforms, we may act as joint controller with the relevant platform provider.

 

We use your data to measure the performance of our services or to create new ones. For example, we analyze your interactions with our network, events, newsletter and/or other promotional messages.

 

Wherever possible, we use anonymous data for these purposes. Personal references will only be made in exceptional cases. In such cases, the following rule applies: subject to your consent to the personalization of our services, the measurement of the effectiveness of our services and the creation of new services are based on our legitimate interest in creating and maintaining services that are genuinely useful to our users.

 

We may use your data to comply with legal obligations and orders to which we are subject, which constitute the legal basis for this processing of your data.

Certain legislation may require us to share your data with public authorities.

 

To the extent permitted by applicable data protection legislation, we may use your data to detect, respond to and prevent illegal behavior or activities that could compromise the security of our services and our website and applications.

Data collected through our partners’ websites and applications: We also receive information about you from our partners’ websites and applications. Our partners must have your consent or another legal basis to transmit your personal data to us.

 

Data collected from publicly accessible sources: We may collect or enrich your personal data with information obtained from publicly accessible sources within the limits of the law applicable to us. Please note that we always carry out a prior check on the possibility of using such information, in accordance with the best practices established by the respective competent authority to which we are subject.

4. How do we use your Data?

This helps us to know, for example, whether the same user is using our services with the same IP or unique identifiers from their browser and device; or whether messages or content of interest to you are linked to your location or activity data or your browser, device and application. You may activate or deactivate the combination and/or cross-referencing of your information for service personalization, as indicated in the section “How to control your data and manage your choices” below.

5. How may we disclose your data?

The cases in which we may share your data with third parties are as follows:  The people we have appointed to carry out any of the data-related activities described in this document: our employees and collaborators who are bound by professional secrecy and comply with specific rules concerning the processing of your data.

 Our subcontractors: external parties to whom we entrust certain processing activities. For example, security system providers, accountants and others, data hosting providers, banks, insurance companies, etc.

 

Our system administrators: our employees or those of our subcontractors to whom we have delegated the management of our IT systems and who therefore have the possibility of accessing, modifying, suspending or restricting the processing of your data.

 Our network of partners: Our network if you have requested a service offered by them or if you have benefited from their assistance. Our selected partners: when you have agreed to your personal data being transmitted to them for their own marketing and/or profiling purposes, and who act as independent data processors.

Public authorities or any other authority whose provisions are mandatory: this is the case when we must comply with a court injunction or a law, or protect ourselves in legal proceedings.

6. Where is your data located?

Our services are accessible worldwide. This implies that your data may be moved, accessed, used, processed and disclosed in different countries, including the European Union, the United States or any other country where our subcontractors and subsequent subcontractors operate, or where their servers or cloud computing infrastructures are located.

 

We ensure that our partners comply with applicable data protection laws, including European law applicable to us. Where required by European data protection law, transfers of your data to partners outside the EU will be governed by adequate safeguards (such as appropriate EU standard contractual clauses for data transfers between EU and non-EU countries), and/or other legal bases consistent with European law.

7. How long do we keep your Data?

We keep your data for as long as is necessary for the purposes described above. If required by law or litigation, we may keep it longer.

We keep your data until you change your mind. After that, we no longer use it for these purposes, but we may still keep it to manage possible claims or lawsuits. We comply with local legislation and data protection authorities for this retention.  If we are required to comply with legal obligations, we will retain your data for as long as required by law.  If we use your data to improve our product and services, we retain it for a maximum of five years.

8. How can you control your Data and manage your choices?

You have the right to request at any time:

– To obtain your Data (right of access): depending on your use of our services, we will provide you with the Data we have on you, such as your name, age, IP address, unique identifiers, e-mails and stated preferences, as well as the privacy policy that was provided to you when you gave them, and the source of the Data (if, for example, it was transmitted to us by one of our partners).

 – To modify your Data (right of rectification): for example, you can ask us to change your e-mail address or telephone number if they are incorrect.

– To object to processing activities based on your consent (right to object).  – To restrict the processing of your Data (right to restrict processing): for example, when you consider that the processing of your Data is unlawful or that processing based on our legitimate interest is not adequate.

– To exercise your right to transfer your personal data (right to data portability): depending on your use of our services, we will provide you with a file in a comprehensible format, containing the data we have on you.

– Delete your data (right to erasure): for example, if you do not wish to use our Services and do not want us to keep your data any longer.

If you do not wish to receive our telephone calls, you can register free of charge on the “Bloctel” opposition list, which can be accessed at www.bloctel.gouv.fr and is managed by Opposetel under a public service delegation agreement.

9. How do we protect your Data?

We implement appropriate physical, technological and organizational protection measures to prevent the loss, misappropriation or modification of data under our responsibility. For example:

 

We train our employees to comply with this Privacy Policy and conduct monitoring activities to ensure ongoing compliance and evaluate the effectiveness of our privacy management practices.

We also reduce the amount of data accessible, transmitted or disclosed to partners to the amount necessary to achieve the partner’s objectives or perform the partner’s specific tasks.  We ensure that your data is accessible and usable only by partners, and that it is transmitted or disclosed only to partners who need to know that data.

 The computers and servers where your data is stored are located in a secure environment, are password-protected with restricted access, and are equipped with industry-standard firewalls and anti-virus software.  Printed copies of any documents containing your Data (if any) are also kept in a secure environment.

We destroy printed copies of documents containing your data that are no longer required.  When destroying data recorded and stored in the form of digital files that are no longer useful, we take care to use an erasure technique (e.g. low-level formatting) that prevents them from being recovered.  Laptops, USB sticks, cell phones and other wireless electronic devices used by our employees who have access to your data are secured. We encourage employees not to store your data on these devices unless reasonably necessary to perform a specific task as described in this Privacy Policy.

 Any subcontractor we use is contractually obliged to maintain and protect your data using measures similar to those described in this Privacy Policy or required by applicable data protection legislation.

Where required by applicable law, any breach of security resulting in the destruction, loss, alteration, unauthorized disclosure of or accidental or unlawful access to data transmitted, stored or otherwise processed, will be notified to you and the relevant data protection authority as required (for example, unless the data is unintelligible to anyone or the breach is not likely to jeopardize your rights and freedoms and those of others).

10. What does this Privacy Policy not cover?

This Privacy Policy describes and explains the processing that we carry out as Data Controller on Our Website and Application. It does not apply to processing carried out by any entity other than us.

In such cases, we are not responsible for any processing of your Data that is not covered by this Privacy Policy.

11. Use of Data for other purposes

Before we start using your Data in a way or for purposes other than those described in this document, we will inform you by means of a specific notice.

12. Changes to the Privacy Policy

We reserve the right to change and/or update this Privacy Policy at any time. We will notify you of any significant changes/updates.
